General Terms and Conditions LUMOIR. Jewelry online shop

 

1. Scope

All legal transactions carried out via the online shop https://lumoir-jewelry.com/ are subject to the General Terms and Conditions (“Terms and Conditions”). The online shop is operated by eVolution Commerce GmbH.

LUMOIR. Jewelry reserves the right to change these Terms and Conditions at any time. The version valid at the time of the order is decisive. This can be viewed at https://lumoir-jewelry.com/pages/agb.

 

2. Offer

Products and prices in the online shop are considered offers. The offer is valid as long as the product can be found in the online shop and is in stock.

 

3. Products, prices and payment methods

The product prices displayed are final prices and include the statutory VAT of the respective country. LUMOIR. Jewelry is free to set prices and change them at any time. When ordering, the prices published on the website apply. LUMOIR. Jewelry reserves the right to notify buyers prior to shipping to agree to price corrections or cancel orders if prices have been posted in error.
By default, prices are given in Swiss francs (CHF).

Shipping and packaging costs, as well as the included VAT, are shown at checkout.

Any cash on delivery delivery from the selected logistics partner is solely the responsibility of the customer.

The payment methods listed on the checkout page are available.

 

4. Information Provided

LUMOIR. Jewelry strives to keep the data published in the online shop current and correct. However, delivery delays may occur due to production/delivery bottlenecks and sales through other channels. Therefore, all information regarding availability and delivery times is without guarantee and can change at any time.

LUMOIR. Jewelry assumes no liability for the accuracy and topicality of information provided by other manufacturers, even if it has been carefully researched.

 

5. Conclusion of contract

A purchase contract is concluded when an order (online) is sent and received by LUMOIR. Jewelry is accepted.

The prerequisite for an effective purchase contract is the complete and truthful completion of the order form available on the Internet and the acceptance of these General Terms and Conditions (GTC).

LUMOIR. Jewelry confirms receipt of the order by sending an automatically generated order confirmation email. This only shows the customer that the order has arrived and the sales contract has been signed with the correct delivery conditions and prices.

 

6. Delivery conditions and availability

Products marked "in stock" are usually delivered within 5-15 working days between Monday and Friday after the order is received.

Delivery service is not available on Saturday and Sunday.
If a product is out of stock or incorrectly marked as "in stock", customers will be notified by email or telephone and a new interim delivery date will be agreed. LUMOIR. Jewelry strives to provide quick replenishments and return orders without increasing shipping costs.

If an item is no longer available and LUMOIR. Jewelry can no longer purchase or produce this, LUMOIR can. Jewelry withdraws from the contract, but must refund the customer in full the amount paid for the product in question.

If additional shipping costs arise due to incorrect delivery addresses or incorrect address details, these will be borne entirely by the buyer.

Depending on availability, goods are shipped from department stores in Switzerland or in Asia. Delivery to EU countries and the USA is duty paid and taxed. Customs and import fees incurred for deliveries outside the EU and USA must be borne by the customer. It is the customer's responsibility to find out about the current customs regulations in their country.

Domestic and international orders are shipped with DHL, DPD, Fedex, UPS or local post office. The regulations, information and the respective logistics partner apply.

 

6.1 Additional provisions for delivery

If the customer does not accept the goods delivered by the supplier within the agreed or stated delivery time, LUMOIR. Jewelry withdraw from the contract, cancel the order and charge the customer a processing fee of 10%, but at least 10 CHF. Fees paid to third parties (payment processors) as part of an order will not be refunded.

 

7. Audit obligations

Delivered or collected products must be checked by the buyer immediately after acceptance for completeness, accuracy and delivery damage. Defects must be reported to LUMOIR. Jewelry must be reported within 7 calendar days. 

If the above-mentioned deadline is violated, the warranty for these defects is void.

 

8. Guarantee conditions and services

LUMOIR. Jewelry sells jewelry under its own brand name. The products are manufactured by carefully selected partners.

The statutory warranty period of 2 years within the EU and at least 1 year in Switzerland applies to all products, unless otherwise agreed.

In addition, voluntary manufacturer guarantees may exist for individual products. These are additional services and do not restrict the statutory warranty rights. In this case, the respective conditions of the guarantor apply.

In the event of a defect, LUMOIR. Jewelry should first carry out a repair or subsequent delivery. If this fails or is unreasonable, the buyer has the legal rights to cancellation or reduction.

Warranty claims can only be asserted by the customer upon presentation of a purchase contract with a valid order.
There are no warranty claims for damage caused by improper handling or defects that are attributable to external influences. This can be, for example, natural damage, moisture damage, fall and impact damage or damage caused by modifications.

 

9. Liability and exclusion of liability

LUMOIR. Jewelry is solely responsible for the warranty services specified in Section 8. No further liability is assumed, especially not for damage that did not occur to the product itself. This includes indirect damages as well as consequential damages such as lost profits, unrealized savings or delays in delivery. LUMOIR is also liable. Jewelry will not be held responsible for damage caused by improper storage.

 

10. Payment

The goods invoice must be paid in the currency specified therein and immediately when or after submitting the order.

The following payment methods are accepted in the online shop: credit cards (Mastercard, Visa, American Express), Klarna, Twint and PayPal.

 

11. Right of withdrawal and cancellation

As a buyer, you have the right to cancel this contract within fourteen days without giving any further reasons.

The cancellation period begins on the day on which you took delivery of the goods and does not apply to replacements, exchange products or special orders such as personalized jewellery. In order to exercise the right of withdrawal, the items must be in their original packaging and undamaged.

If you would like to exercise your right of withdrawal, we must be informed of this decision by contacting us eVolution Commerce GmbH Löhrstrasse 53, 4552 Derendingen, Switzerland, send a corresponding declaration signed by you by post or email to info@lumoir-jewelry.com.

The date on which your cancellation declaration is sent is decisive for compliance with the cancellation period.

 

11.1 Consequences of revocation

In the event of cancellation, we will reimburse you for all payments made by you, including delivery costs, within a maximum of 14 days of receipt of the cancellation. The refund will be made using the same payment method that you chose when placing your order.

We may refuse repayment until we have received the goods back or until you have provided evidence that you have sent the goods back, whichever is the earlier. You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you notify us of your cancellation of this contract. The deadline is met if you send the goods before the fourteen day period has expired.

You bear the direct costs of returning the goods.

If the goods lose value, you are responsible for this if this is due to use that exceeds the examination of the properties, nature or function of the goods.

 

12. Data Protection

LUMOIR. Jewelry only collects the personal data necessary to conclude a contract. These will not be processed further without the buyer’s separate consent. Data will only be passed on to third parties if this is necessary to process the order. For home delivery, this applies to logistics partners (e.g. post offices) and banks when processing payments.

 

13. Application of law and place of jurisdiction

The relationship between LUMOIR. Jewelry and its customers are entirely subject to Swiss law. The place of jurisdiction is the city of Solothurn in the canton of Solothurn, Switzerland.

 

14. Alternative Dispute Resolution

The EU Commission provides a platform for online dispute resolution on the Internet at the following link: https://ec.europa.eu/consumers/odr

This platform serves as a contact point for the out-of-court settlement of disputes arising from online purchase or service contracts in which a consumer is involved.

 

14.1 Participation in dispute resolution procedures

As a seller, we are neither obliged nor willing to take part in a dispute resolution procedure before a consumer arbitration board.
